If your account is terminated, under no circumstances will you be credited for earnings that violate the terms of this membership agreement or for any contest winnings or any other reward:

A.1)You must be at least 18 years of age and a citizen of the United States, Canada or United Kingdom.

A.2) ACTIVITY LEVEL/COMPENSATION. Members earn cash and prizes from the Treasure Cove for completing marketers’ offers. All offers are worth a specific amount of cash and/or Gold Coins redeemable for various prizes. Members are required to complete the offer in full with truthful and accurate information and be verified before credits are posted. Members may redeem their accumulated cash and gold coins for prizes at any time, but will not be delivered until the last day of the following month in which the request was made. In rare cases, advertisers utilize their right to extend a transaction for one month. If a transaction is extended, the member is credited by the last day of the month following the month after the month in which the offer was completed. This does not happen often, but can if an advertiser believes fraud or ill intentions were derived during the offer.

A.3) APPROVED TERRITORIES. The CrazyMonkeyGold.com Service is currently available only in the United States, Canada and United Kingdom. You must be physically located within the United States, Canada or United Kingdom while using the CrazyMonkeyGold.com Service, be a legal resident of the United States, Canada or United Kingdom and have a physical mailing address in the United States, Canada or United Kingdom.

A.4) ONE ACCOUNT PER MEMBER. You may only sign up once and maintain one Membership in the Service per household. CrazyMonkeyGold.com reserves the right to terminate duplicate accounts, resulting in the potential loss of accumulated credits.

A.5) PROVIDE ACCURATE INFORMATION/ACKNOWLEDGEMENT OF USER RESPONSIBILITY. You must provide CrazyMonkeyGold.com with your full name, address, telephone number and valid email upon sign up. CrazyMonkeyGold.com reserves the right to request verification of, and member agrees to be subject to verification of, any of the information provided by member for enrollment with and continued use of the services provided by CrazyMonkeyGold.com. You may not impersonate or misrepresent your identity. CrazyMonkeyGold.com reserves the right to terminate any account, and associated membership, containing untruthful information. CrazyMonkeyGold.com is not responsible for lost credits, prizes or communications due to your failure to provide CrazyMonkeyGold.com with valid contact information as reasonably necessary. Further, by completing offers through CrazyMonkeyGold.com, you acknowledge that you will most likely be contacted by advertisers through one or all of the following methods: phone, postal mail or/and email. Advertisers contact members using information provided by the member during completion of the offer. If the member no longer wishes to be contacted by the advertiser, it is their responsibility to unsubscribe with the particular advertiser that is contacting them since CrazyMonkeyGold.com is not affiliated with the entity contacting the member. Furthermore, by joining CrazyMonkeyGold.com members acknowledge to be contacted by CrazyMonkeyGold.com for necessary administrative purposes and updates. Members may opt-out at any time from receiving emails from CrazyMonkeyGold.com by using the “Edit Account” function in the member area.

A.6a) ENROLLMENT. To the full extent allowed by applicable law, CrazyMonkeyGold.com at its sole discretion and for any or no reason may refuse to accept applications for membership. In addition, CrazyMonkeyGold.com reserves the right to discontinue any account at our sole discretion without notice or reason at any time.

A.6b) NEWSLETTER AND OTHER EMAILS. Upon signing up, members are given the option to opt in to receive a newsletter, promotional and additional update emails. Users may opt-out at any time to discontinue receiving these emails using our Contact Us page or using the “Edit Account” function in the member area and removing the checkmark in the box to receive emails.

A.7) ACCOUNTS ARE NON-TRANSFERABLE. You, yourself must accrue credits under your own account.

A.8) TERMINATION AND CANCELLATION. CrazyMonkeyGold.com at its sole discretion and for any reason or no reason at all may terminate any Member account without prior notice for (a) any violation of any provision of this Agreement; (b) aiding in or promoting circumvention of the CrazyMonkeyGold.com Service; (c) acting against the business interests or reputation of CrazyMonkeyGold.com; (d) otherwise acting unlawfully in relationship to CrazyMonkeyGold.com, the CrazyMonkeyGold.com website or the CrazyMonkeyGold.com Service; (e) breach of our Spamming Policy; (f) inactivity (defined as the failure to earn any credits in your CrazyMonkeyGold.com account) for a continuous six-month period; or (g) any other reason at the discretion of CrazyMonkeyGold.com. If your account is terminated by CrazyMonkeyGold.com, You may re-enroll or join under a new account, if eligible.

A.9) MEMBER ETIQUETTE. Member shall not tamper, hack, spoof, copy, modify, or otherwise corrupt the administration, security, or proper function of any part of CrazyMonkeyGold.com. Member shall not use robots or scripts with CrazyMonkeyGold.com. Violation by member will result in termination of membership, loss of all accrued credits and bar from future participation with the service of CrazyMonkeyGold.com. Any decision made by CrazyMonkeyGold.com relating to termination of membership in cases of suspected abuse or violation of its rules shall be final and binding.

A.10) SPAM. CrazyMonkeyGold.com has a very strict anti-spam policy in place to protect our members and comply with Anti-Spam laws. You are not permitted at anytime to promote your referral links or banners in any way that violates the policies of other sites the links/banner are being placed on. You are also prohibited from spamming (emailing) through uninvited means, including purchased lists and random email lists. Violations of this section will result in immediate termination of your account and all earnings forfeited without notice. We take Spam very seriously and will not tolerate infractions to this policy.

B. YOUR RELATIONSHIP TO CRAZYMONKEYGOLD.COM. By filling out the membership information, You are applying to receive a service. Your relationship to CrazyMonkeyGold.com is one of an independent contractor. No employee-employer relationship is created by Your use of the Service. You are fully responsible for filing local, state, or federal or any other taxes if applicable on any compensation received as a result of Your participation in the Service. When you reach $600+ of cash and/or prize earnings, CrazyMonkeyGold.com will request a form W-9 for the purposes of tax filing as required by law. Your account will be placed on hold until this form is returned completed in full and accepted. CrazyMonkeyGold.com will report all earnings of $600+ in cash and/or prizes to the IRS as required by law.

C. NO TAMPERING. You agree not to tamper with the proper functioning and tracking of the Service. Emulating or "faking" submissions will lead to termination of Your account and may lead to legal action. Duplicate offer submissions will result in immediate account termination and are tracked.

C.1) CrazyMonkeyGold.com does not warranty, guarantee, or insure the quality of any product or service requested from merchants. We are not affiliated with any of the merchants/advertisers in any way.

D. TERMINATION. If a Member's account is terminated by CrazyMonkeyGold.com, CrazyMonkeyGold.com may refuse to credit some or all of the amounts accrued to the terminated Member's account if such amounts were earned in violation, or after violation, of this Agreement or were otherwise unlawfully obtained by the Member. Similarly, CrazyMonkeyGold.com will have no obligation to credit a Member for amounts credited to the Member's account that were earned in violation or after violation of this Agreement by any of the Member's direct or extended referrals. If your account is terminated by CrazyMonkeyGold.com, You may not re-enroll or join under a new account unless formally invited to do so by CrazyMonkeyGold.com.

E. DISCLAIMER OF WARRANTIES. YOU EXPRESSLY AGREE THAT USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW. CRAZYMONKEYGOLD.COM EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED BY LAW, CUSTOM OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, SATISFACTORY QUALITY, AND FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. CRAZYMONKEYGOLD.COM MAKES NO WARRANTY REGARDING ANY GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH THE SERVICE OR ANY TRANSACTIONS ENTERED INTO THROUGH THE SERVICE.

F. LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, NEITHER CRAZYMONKEYGOLD.COM NOR ANY OF ITS MEMBERS, SUBSIDIARIES, PUBLISHERS, SERVICE PROVIDERS, LICENSORS, OFFICERS, DIRECTORS OR EMPLOYEES SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THIS AGREEMENT, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE OR FOR THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH THE SERVICE OR RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF USER'S TRANSMISSIONS OR DATA, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL CRAZYMONKEYGOLD.COM\'S TOTAL CUMULATIVE LIABILITY TO ANY MEMBER UNDER THIS AGREEMENT EXCEED AN AMOUNT EQUAL TO: THE NUMBER OF CREDITED SEARCHES THAT THE MEMBER PERSONALLY COMMITTED DURING THE IMMEDIATELY PRECEDING TWO MONTHS, MULTIPLIED BY THE MAXIMUM CREDIT RATE PER SEARCH AVAILABLE ON THE CRAZYMONKEYGOLD.COM SERVICE DURING THAT SAME PERIOD PLUS THE SUM OF THE POSTED CREDIT AMOUNTS EARNED FOR RESPONDING TO OFFERS DISPLAYED BY CRAZYMONKEYGOLD.COM.
